This paper addresses the effects that insolvency of a party to an arbitration agreement may have on a pending international arbitration in a cross-border context. In particular it is concerned with what, if any, attention an arbitral tribunal seated in one country must pay to the corporate insolvency laws of another country that are applicable to a party to a pending arbitration when insolvency proceedings are opened against that party.
